These Phoenix Pro Plan Terms (“Plan Terms”) describe plan eligibility, included features, exclusions, and usage limits for Phoenix Code Pro plans (“Phoenix Pro”). These Plan Terms apply in addition to the Phoenix Code License Agreement and, for Company-operated online services, the Terms of Service.
Where these terms appear: Plan details may also be shown at checkout, on invoices, in-product, or in your account portal. If there is a conflict for a specific purchase, the terms shown at checkout/order confirmation for that purchase control.
Phoenix Pro may be offered in one or more of the following plan types:
Availability of specific plans may vary by country, channel, or promotion.
The Product may contain both Community and Pro functionality in the same distribution. Pro features are available only while you have an active Pro entitlement (or as otherwise stated for Lifetime on-device features).
Some Pro features depend on Online Services. These features may change, be limited, or be discontinued over time, and access may depend on your plan type and eligibility.
Where we elect to discontinue an Online Service (or a paid feature that materially depends on that Online Service) for paid Phoenix Pro plans, we will use commercially reasonable efforts to provide at least thirty (30) days’ advance notice where reasonably practicable. We may discontinue or suspend Online Services immediately (or with shorter notice) if required by law, to address security, fraud, or abuse, or to prevent material harm to the Company, users, or third parties.
Phoenix Pro can be used on any number of your own personal devices, as long as the devices belong to you (the account owner) and you are the one using the plan. You may not share your plan, credentials, or entitlements with others.
The Image Library may be available only for certain plan types and regions. Availability may vary due to provider terms, legal requirements, or service capacity.
For eligible Phoenix Pro subscription users, Image Library usage is limited to:
The monthly limit resets at the start of each calendar month (based on our service records).
The monthly limit counts both searches and downloads. For clarity:
Previewing images already returned in the current results view does not count as an additional search unless the Product makes a new request to fetch more results.
If you reach the monthly limit, Image Library search and download features may be restricted until the limit resets. We may also apply temporary throttling or limits during unusual traffic, capacity constraints, or abuse-prevention events.
Pro Education entitlements do not include Image Library search or downloads, unless explicitly stated at purchase, in-product, or in a written agreement with the Company.
If you are on a Pro Education plan, the Image Library feature may be hidden, disabled, or unavailable.
The Image Library may include images provided by third parties (for example, Unsplash). Your rights to use those images come from the applicable third-party license and terms, not from the Company.
For Unsplash-sourced images, usage is subject to the Unsplash License and related terms. In summary, Unsplash allows broad use (including commercial use), but prohibits certain uses — including selling images without significant modification and compiling images to replicate a similar or competing service. Unsplash’s license grants rights to use the photo itself, but it does not grant rights to third-party content that may appear in a photo (for example: trademarks/logos/brands, recognizable people, or copyrighted works/characters). You are responsible for obtaining any additional permissions required for your intended use and for complying with applicable law.
Lifetime Plan purchases include updates and service-backed feature access only through the Lifetime Update Period stated at purchase (for example, on the checkout page and/or order confirmation).
After the Lifetime Update Period ends:
Unless explicitly stated at purchase, Lifetime Plans generally do not guarantee ongoing access to service-backed features (including the Image Library) beyond the Lifetime Update Period.
Trial availability, duration, and included features may vary by promotion, product version, region, or account history, and will be shown in-product at the time the trial is offered.
Trials may have feature limits, usage caps, or other restrictions. If a trial ends, Pro features may be reduced or disabled unless you purchase a paid plan.
We may enforce plan eligibility rules and usage limits through measures such as rate limiting, throttling, feature restrictions, verification checks, suspension, or termination to protect the Services and users.
Examples of prohibited behavior include attempting to bypass limits, automating downloads, sharing entitlements where not allowed, or using the Services in a way that creates excessive load.
We may update these Plan Terms from time to time. The latest version will be posted on our website.
